Abstract

This article examines the legal foundations of a transit agent's civil liability to the principal under Algerian law. It addresses the legal questions raised by the agent's legal status and seeks to define the scope of liability toward the principal. This inquiry is especially important because Algerian legislation contains no specific provisions governing transit agents. By contrast, it expressly regulates accredited customs brokers.

The study first examines the nature of the transit agent's activities and the legal classification of the relationship with the principal. Both questions must be resolved before the agent's obligations and the applicable legal rules can be identified. It then considers the legal basis, conditions, and scope of civil liability. A distinction is drawn between acts performed by the agent and those carried out through third parties. The analysis also considers contractual clauses that seek to exclude liability or limit its extent.
