Mechanisms and Methodological Approaches of the Administrative Judge in Assessing the Legality of Administrative Acts Artificial Insemination in Algerian Law

Abstract

This article examines the mechanisms and methodological approaches used by the administrative judge to assess the legality of administrative acts. It begins by clarifying the concept of judicial review and distinguishing it from administrative review, with attention to the principle of legality and the protection of rights and freedoms. The study then analyses the powers of the administrative judge in actions concerning legality and annulment. It also identifies the judicial grounds used to determine whether an administrative decision is lawful. These include lack of jurisdiction, defects in form and procedure, violation of law, misuse of power, and absence of legal cause. The article shows that judicial review constitutes an essential guarantee against unlawful administrative action while preserving the requirements of the public interest. It concludes that the effectiveness of administrative justice depends on respect for standards, judicial independence, the rule of law, and human rights within the Algerian legal system.
